These Terms of Service (“Terms”) govern your use of bookyachtsy.com (the “Site”) and any services offered by Yachtsy (“Yachtsy,” “we,” or “us”), including our SMS messaging program. By accessing the Site or booking a cruise, you agree to these Terms. If you don’t agree, please don’t use the Site or our services.
Agreement & Eligibility
You must be 18 or older to book a cruise. You agree to use the Site only for lawful purposes, and not to misuse it or interfere with anyone else’s use of it.
Bookings & Payment
Every Yachtsy cruise is a private, 2-hour booking of the entire boat for up to 8 guests — available any day of the week at a flat rate of $380, with no weekend surcharge. Reservations are made online with instant confirmation, and payment is collected at the time of booking.
Drivers & Boating Safety
No boating experience is required to book. You can add a driver for $25 per hour, paid directly to the driver on the day of your cruise. Your driver does not count toward your 8-guest maximum.
If you’d like to drive the boat yourself, Yachtsy’s requirements go beyond the state minimum: the operator must be 25 or older and hold a U.S. Coast Guard captain’s license (a 6-pack/OUPV license or higher) — a state boater safety card on its own isn’t enough. If no one in your group meets that bar, you’ll add a driver when you book.
Cancellations & Rescheduling
Plans change, and we get it. You may reschedule or cancel for a full refund as long as you give at least 48 hours’ notice before your cruise.
- Within 48 hours of your cruise, bookings are non-refundable, and rescheduling is offered only at our discretion and subject to availability.
- Weekday reservations cannot be moved into weekend time slots.
- To cancel or reschedule, simply reply to your booking confirmation email.
Conduct, Alcohol & Safety
Bringing your own food and drinks is the heart of the Yachtsy experience. In return, we ask every guest to keep it safe and respectful:
- No smoking of any kind, including cigars and hookah.
- Please drink responsibly. We may turn away guests who are intoxicated before departure, without a refund, and disruptive behavior that risks safety will end the cruise without a refund. Boating while intoxicated is prohibited by District of Columbia law.
- No swimming — swimming in the Inner Harbor is prohibited by law.
- Life jackets are provided for all ages; children 13 and under must wear one at all times on the water.
- Pets are welcome; any pet over 25 lbs counts as one of your 8 guests.
- Returning the boat late is billed as additional time, including any delay caused to the next group.
Assumption of Risk & Liability Waiver
Boating is wonderfully relaxing and, like any activity on the water, carries inherent risks. By booking, you accept those risks on behalf of your group. Every guest signs a liability waiver and safety acknowledgment before boarding, and a parent or legal guardian must sign for any guest under 18.
Weather
If Yachtsy cancels your cruise for unsafe weather, you choose between a free reschedule or a full refund. We monitor conditions for both harbors and reach out if your date looks questionable. Light rain and overcast skies are not cancellations.
SMS Messaging Program
If you opt in, Yachtsy may send recurring automated promotional and personalized marketing text messages (such as special offers and booking reminders) to the mobile number you provide.
- Consent: you opt in by checking the box on our sign-up form. Your consent is not a condition of any purchase.
- Cost & frequency: message and data rates may apply, and message frequency varies.
- Opt out: reply STOP (or END, CANCEL, UNSUBSCRIBE, or QUIT) to any message, or text STOP to +1 (202) 999-6787. We’ll send one final message to confirm.
- Help: reply HELP to any message, or email info@bookyachtsy.com.
All messages identify “Yachtsy” as the sender. Your mobile information is handled under our Privacy Policy.
Intellectual Property
The Site and its content — including the Yachtsy name, logo, text, and photography — belong to Yachtsy or its licensors and are protected by law. Please don’t copy, reproduce, or use them without our written permission.
Limitation of Liability
Our services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Yachtsy is not liable for indirect, incidental, or consequential damages arising from your use of the Site or your cruise, except where such liability cannot be limited under applicable law.
Governing Law
These Terms are governed by and construed in accordance with the laws of the District of Columbia and the State of Maryland, without regard to conflict-of-law principles.
